AN EXPERT SYSTEM FOR ASSESSING ENGINEERING--RELATED DELAY CLAIMS IN CONSTRUCTION PROJECTS

Abstract


Claims •and disputes are common problems, which are faced in construction projects. These problems occur frequently during the project lifetime leading to litigation. Delays are the most common and costly problem encountered in construction projects. Studying and analyzing construction delays have become an essential part in such projects. Therefore, it is essential to define actual causes of delays in order to reduce
such delays in construction projects.


Delays in construction are attributed to faults or deficiencies of any of the construction contract parties (either the. employer or the contractor) individually or collectively. Delays may also occur due to a fault of a third party. This research presents an overview of the major categories of construction projects delay causes. These categories are: engineering-related, construction-related, financial/economic, management/administrative and force majeure. The study focuses on the delays that are related to engineering factors which arise due to: 1) design development, 2) work shop drawings, 3) change.


Rule-based computer models are regarded as a good technique for organizmg comprehensive information and capturing the attitude of construction claim experts in settling cases. The research also presents a system (ES_EngClaim), dedicated to assess construction project's delay claims that are related to engineering. The system is generic and can be used by all project parties. It can be used by the employer or contractor who plans to submit a claim in knowing whether s/he is entitled for that claim or not. Also, it can be used by the project Engineer to support the decision of acceptance/rejection submitted claims. In addition, the system is considered an important tool for the arbitrators who don't have engineering knowledge and scheduling techniques, since it provides them with the analysis and delay• figures of each litigated case.


ES_EngClaim is a knowledge based expert system that has interest features. It feeds its user with the claim entitlement, responsibility, and compensability of each studied case. The knowledge of the system is acquired from literature, FIDIC forms of contract, domain experts, as well as questionnaire surveys. The latter were designed to retrieve practitioners feed back towards the preliminary factors affecting engineering-related delay claims along with their opinion regarding the delay responsible party relevant to each factor. ES_EngClaim also analyzes the claim procedures followed by the claimant with respect to the contracted procedures in
order to evaluate the validity of the studied case. To achieve this feature, the system's
